Garbage Disposal Service Terms and Conditions

These Terms and Conditions set out the basis on which we provide garbage disposal and waste collection services to domestic and commercial customers within our service area in the United Kingdom. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming your order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business or organisation requesting our garbage disposal or waste collection services.

Services means the collection, removal, transportation and disposal or recycling of waste as agreed in the booking confirmation.

Waste means any rubbish, refuse, junk, bulky items, or other materials presented by the Customer for collection, excluding any prohibited or hazardous items described in these Terms and in applicable waste regulations.

Service Area means the locations within the United Kingdom in which we operate and accept bookings for waste collection, as described in our current service coverage information and as confirmed at the time of booking.

Contract means the agreement between us and the Customer for the provision of Services, formed upon our confirmation of a booking.

2. Scope of Services

We provide garbage disposal and waste collection services for domestic households, landlords, letting agents, property managers and commercial customers within our service area. Services may include one-off clearances, scheduled collections, bulky waste removal, and other related waste management services as described at the time of booking.

The specific scope, timing and price of the Services will be confirmed to the Customer during the booking process. We reserve the right to refuse service where the requested collection falls outside our typical operational capabilities or service area.

3. Booking Process

3.1 Booking requests

Customers may request a booking by phone or online using our designated channels. When making a booking request, the Customer must provide accurate and complete information, including but not limited to:

a. The full collection address and any access instructions within our service area.

b. A description of the type, approximate volume and weight of waste to be collected.

c. Any known hazards, restricted access, or special handling requirements.

d. The preferred collection date and time window, subject to availability.

3.2 Booking confirmation

A booking is not accepted and no Contract is formed until we confirm the booking in writing or by electronic communication. The confirmation will set out the agreed Services, the collection date or time window, and the price or pricing basis.

Where the information provided by the Customer is unclear or incomplete, we may request additional details or images of the waste before confirming the booking.

3.3 Changes to bookings

Any changes to a confirmed booking, including alterations to the type or quantity of waste, the collection date or location, must be requested by the Customer as early as possible. We will use reasonable efforts to accommodate changes but cannot guarantee that all requests will be accepted. Changes may result in adjustments to the price or to the scheduled collection time.

4. Service Access and Customer Obligations

The Customer must ensure that:

a. Reasonable and safe access is available to the collection point at the agreed time.

b. Waste is presented as described during the booking, safely stacked or contained where required.

c. Any necessary permissions for access over private land, shared areas or restricted zones have been obtained.

d. Vehicles can park or stop lawfully and safely near the collection point.

If we are unable to carry out the Services due to lack of access, unsafe conditions, or inaccurate information supplied by the Customer, we may cancel the visit or charge a reasonable abortive or waiting fee.

5. Waste Types and Regulations

5.1 Acceptable waste

We will collect most non-hazardous household and commercial waste types, including general rubbish, bulky items, furniture, appliances, garden waste and similar materials, provided that these have been accurately described in the booking.

5.2 Prohibited and hazardous waste

We do not accept certain hazardous or prohibited items, which may include but are not limited to:

a. Asbestos or materials suspected of containing asbestos.

b. Clinical or medical waste, syringes or infectious materials.

c. Corrosive, flammable, explosive or toxic substances including some chemicals, solvents, oils and fuels.

d. Pressurised containers, gas bottles and certain batteries.

e. Any items classified as hazardous under applicable waste regulations.

The Customer is responsible for declaring any potentially hazardous waste in advance. If hazardous or prohibited items are discovered at the time of collection, we may refuse to remove them and may charge for any additional time or costs incurred.

5.3 Compliance with waste regulations

We operate in accordance with applicable UK waste management and duty of care regulations. Waste collected by us will be transported and transferred only to appropriately authorised facilities or carriers. Where required, we will issue or complete any relevant documentation to evidence lawful transfer of waste.

The Customer must not request or encourage any service that would breach applicable waste regulations, including unlawful dumping or disposal. If we reasonably believe that a requested service could be unlawful, we may refuse to provide it.

6. Payments and Charges

6.1 Pricing

Our charges are based on factors that may include the type of waste, volume or weight, labour required, access conditions, and the distance to disposal facilities. The applicable pricing or pricing basis will be communicated to the Customer during the booking process.

6.2 Quotations

Any price quoted prior to the collection is an estimate only and is subject to confirmation on site. Where the actual waste, access conditions or labour required differ from the information originally provided, we reserve the right to adjust the price accordingly before proceeding with the collection.

6.3 Payment terms

Unless otherwise agreed, payment is due at or before the time of collection. We may accept payment by cash, card or other methods specified at the time of booking. For business customers with approved credit arrangements, invoices will be issued in accordance with the agreed terms and are payable within the specified period.

If the Customer fails to make payment when due, we may withhold or suspend Services and charge interest on overdue amounts at a reasonable commercial rate until payment is received in full.

7. Cancellations and Rescheduling

7.1 Customer cancellations

The Customer may cancel or reschedule a booking by contacting us using the same channel through which the booking was made. To avoid cancellation charges, the Customer should provide as much notice as reasonably possible prior to the agreed collection time.

We reserve the right to apply a reasonable cancellation fee where a confirmed booking is cancelled on short notice, where staff and vehicles have already been allocated, or where we arrive on site and are unable to carry out the work due to circumstances within the Customer's control.

7.2 Our right to cancel or postpone

We may cancel or postpone a booking where:

a. There are severe weather conditions or events beyond our reasonable control affecting safety or access.

b. The Customer has provided incomplete, inaccurate or misleading information.

c. We reasonably believe that carrying out the collection would be unsafe, unlawful or in breach of applicable waste regulations.

In such cases, we will aim to notify the Customer as soon as reasonably practicable and, where possible, offer an alternative collection date. Our liability in such circumstances will be limited as described in the liability section below.

8. Performance of Services

We will use reasonable skill and care in providing the Services and will endeavour to carry out collections within the agreed time window. However, time is not of the essence, and we do not guarantee that we will arrive at an exact time.

The Customer or their authorised representative should, where possible, be present at the collection address to clarify any instructions and to confirm the waste to be removed. If no representative is present, we will use our reasonable judgment to carry out the collection in line with the booking information, and our assessment of the waste removed will be final for billing and documentation purposes.

9. Liability and Limitations

9.1 Our responsibility for loss or damage

We will take reasonable care when performing the Services at the collection address. However, we shall not be liable for any pre-existing damage, wear and tear, or deterioration to property, surfaces or items.

Our liability for any loss or damage arising from or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable for the specific collection during which the incident occurred, except where such limitation is not permitted by law.

9.2 Exclusions of liability

We will not be liable for:

a. Any indirect or consequential loss, including loss of profit, income, business or enjoyment.

b. Any loss arising from the Customer's failure to comply with these Terms and Conditions.

c. Any delay or failure in performance caused by events or circumstances beyond our reasonable control, such as traffic, road closures, severe weather, or industrial action.

9.3 Non-excludable rights

Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Customer Warranties and Indemnity

The Customer warrants that:

a. They have lawful authority to request removal of the waste from the collection address.

b. The waste to be collected has been accurately described and does not contain prohibited or undisclosed hazardous materials.

c. All necessary permissions for access, loading and parking have been obtained.

The Customer agrees to indemnify us against any claims, losses, damages, costs or expenses arising from a breach of these warranties, from the inclusion of hazardous or prohibited waste, or from any failure to comply with applicable laws relating to the waste or the property from which it is collected.

11. Data Protection and Privacy

We may collect and process personal data relating to the Customer for the purposes of administering bookings, delivering the Services, handling payments, and maintaining records in accordance with applicable data protection laws. We will take appropriate measures to safeguard such personal data and will not share it with third parties except where necessary to provide the Services, process payments, comply with legal obligations, or as otherwise permitted by law.

12. Complaints and Dispute Resolution

If the Customer has any concerns or complaints about the Services, they should contact us as soon as possible, providing details of the issue and any supporting information. We will investigate complaints in a fair and timely manner and will aim to resolve any disputes by negotiation or other informal means where possible.

If a dispute cannot be resolved directly between the parties, either party may pursue any remedies available under applicable law.

13. Amendments to these Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, operational practices, legal requirements, or for other valid reasons. Any such changes will apply to bookings made after the revised Terms and Conditions are published or made available to Customers. The version in force at the time of booking will govern the relevant Contract.

14. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision shall be deemed deleted from the Terms and the remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

These Terms and Conditions, and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to hear and determine any disputes or claims arising out of or in connection with these Terms and Conditions or the provision of the Services, including any non-contractual disputes or claims.
